Welcome to https://Patio-Pumpkins.com (the “Site”). These Terms & Conditions (“Terms”) govern your use of our Site and the purchase of porch‑decor services (the “Services”). By accessing or using the Site or booking Services, you agree to be bound by these Terms.

1. Definitions

  • “Company,” “we,” “us”: Patio Pumpkins, LLC.

  • “Customer,” “you”: Anyone who visits our Site or books Services.

  • “Services”: Delivery and installation of seasonal pumpkins, gourds, decor, and related items on residential entryways.

2. Acceptance of Terms

By using the Site or booking Services, you affirm that you are at least 18 years old, have capacity to enter into these Terms, and agree to abide by them.

3. Services & Bookings

  1. Booking Process:

    • Select a package, choose a date, provide address, and submit payment details.

    • We will confirm availability via email within 7 business days.

  2. Service Location:

    • We serve Charlotte County, FL and surrounding zones as listed on our Service Area page.

  3. On‑Site Requirements:

    • A clear, level porch or entryway area must be provided.

    • Customer is responsible for safe access (removal of obstacles, pets).

4. Payment & Pricing

  1. Pricing:

    • All prices are as shown on the Site and are subject to change without notice.

    • A delivery/installation fee applies based on zone.

    • Zone-Based Fees Are Estimates. All delivery/installation fees are estimates based on the zone you choose at checkout. Patio Pumpkins reserves the right to verify your actual service address and adjust the delivery fee to the correct zone. We will notify you of any change and collect (or refund) the difference prior to completing the service.

  2. Payment Terms:

    • Full payment (or deposit, if offered) is required at booking via Stripe.

    • We do not store full card data; payments processed securely by Stripe.

5. Cancellations & Refunds

  1. By Customer:

    • Cancellations made ≥20 days before the booked date receive a full refund.

    • Cancellations 7 days prior incur a 50% fee.

    • Cancellations <2 days prior are non‑refundable.

  2. By Company:

    • We reserve the right to reschedule due to severe weather or emergencies, with notice.

    • If we cannot fulfill your booking, you will receive a full refund.

6. Site Usage Rules

  • You may not copy, distribute, or modify any content on the Site without our written permission.

  • You may not use the Site to transmit unlawful or harmful content.

7. Intellectual Property

All Site content—text, graphics, logos, images, and design—is the property of Patio Pumpkins or its licensors, and is protected by U.S. and international copyright laws.

8. Disclaimers & Limitation of Liability

  1. Disclaimer of Warranties:

    • Services and Site are provided “as is” and “as available,” without warranties of any kind.

  2. Limitation of Liability:

    • To the maximum extent permitted by law, Company’s total liability for any claim arising out of or relating to these Terms or Services shall not exceed the amount you paid for the Services.

9. Indemnification

You agree to indemnify and hold Company, its officers, agents, and employees harmless from any claims, liabilities, damages, or expenses (including attorneys’ fees) arising out of your breach of these Terms or your negligence or willful misconduct.

10. Governing Law & Dispute Resolution

These Terms and any dispute arising hereunder shall be governed by the laws of the State of Florida, without regard to conflict‑of‑law principles. Any legal action must be brought in the state or federal courts located in Charlotte County, FL.

11. Changes to Terms

We may update these Terms at any time. The “Last updated” date will reflect changes. Continued use of the Site or Services after changes constitutes acceptance of the new Terms.
